These Terms of Service (“Terms”) govern your use of the Cher mobile app (“Cher,” “the app”), operated by Phinke, LLC (“we,” “us”). By creating an account or using the app, you agree to these Terms, our Privacy Policy, and our Data Policy. If you don’t agree, please don’t use the app.
Eligibility
You must be at least 13 years old to use Cher. By using the app you confirm that you meet this requirement and that the information you provide is accurate.
Your account
You’re responsible for keeping your login credentials secure and for activity that happens under your account. Let us know promptly if you suspect unauthorized use.
Your content
You keep ownership of the photos and information you add to Cher (“your content”). You grant us a limited license to host, store, and process your content, including sending photos to the third-party AI and search services described in our Privacy Policy, to provide and improve the app’s features. You’re responsible for ensuring you have the right to upload any content you provide.
Data and privacy
How we handle your information is described in our Privacy Policy and Data Policy. As explained there, we may sell and share certain data, such as the brands, sizes, and styles you buy and prefer, but never your photos. You can opt out of the sale and sharing of your personal information at any time from Profile → Privacy in the app. By using Cher without opting out, you consent to these practices.
Acceptable use
You agree not to:
- Upload content that is unlawful, infringing, or that you don’t have the right to share.
- Attempt to disrupt, reverse-engineer, overload, or gain unauthorized access to the app or its systems.
- Use the app to violate any applicable law or the rights of others.
Identification results and shopping links
Cher uses automated AI to identify clothing and suggest matching products and links. These results are best-effort and may be inaccurate or incomplete. Brand names, product matches, prices, availability, and links are provided for convenience and are not guaranteed. Any purchase you make from a third-party retailer is solely between you and that retailer; we are not a party to those transactions and are not responsible for them. Some links may be affiliate links.
Service availability
We provide the app on an “as is” and “as available” basis. We may change, suspend, or discontinue features at any time, and we don’t guarantee the app will always be available or error-free.
Disclaimers and limitation of liability
To the fullest extent permitted by law, the app is provided without warranties of any kind, express or implied. To the fullest extent permitted by law, we will not be liable for any indirect, incidental, or consequential damages, or for any loss of data, arising from your use of the app.
Termination
You may stop using Cher and delete your account at any time from Profile → Delete Account. We may suspend or terminate access if you violate these Terms or use the app in a way that could harm others or us.
Governing law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules.
Changes to these Terms
We may update these Terms from time to time. We’ll update the “Last updated” date above, and your continued use of the app after changes take effect means you accept the updated Terms.
